This section serves as the guiding philosophy for all authorities under the Act. It mandates that the government must ensure a high level of protection for human life and health. It emphasizes "Risk Analysis" (Risk Assessment, Risk Management, and Risk Communication) and requires that where there is uncertainty regarding potential adverse effects on health, the authorities may adopt precautionary measures until further scientific evidence is available.

Chapter IV: General Provisions as to Articles of Food

Section 19: Use of food additives or processing aids

Section 24: Restrictions of advertisement and prohibition as to unfair trade practices

Section 26: Responsibilities of the food business operator (FBO)
The FBO is responsible for ensuring that food satisfies the requirements of the Act at all stages of production, processing, and distribution. If an FBO has reason to believe that any food is not safe, they must immediately initiate procedures to withdraw it from the market and inform the competent authorities.

Section 27: Liability of manufacturers, packers, wholesalers, distributors, and sellers
Manufacturer/Packer: Liable for the quality and safety of the product.
Wholesaler/Distributor: Liable if they store food incorrectly or knowingly distribute unsafe/misbranded food.
Seller: Liable for selling food that is unfit for human consumption, unless they can prove they acted in good faith and had no reason to believe the food was unsafe.

 Section 28: Food recall procedures
If an FBO determines that food poses a risk, they must immediately remove it from the supply chain and notify consumers. The Authority may also issue a recall order if the FBO fails to do so voluntarily.

Section 33: Prohibition orders: If an FBO fails to comply with an improvement notice or if the health risk is imminent, the designated officer may issue an order prohibiting the FBO from using a specific process, premises, or equipment.
Section 34: Emergency prohibition notices and orders: Used in cases where there is an "imminent risk" to health. The authorities can immediately stop the food business operations without waiting for a prior notice.

Section 39: Liability of Food Safety Officer: Protects the officer for actions taken in "good faith," but also makes them liable if they exercise their powers vexatiously or without reasonable grounds.
Section 40: Purchaser may have food analysed: Any person (a consumer) can have food analyzed by a Food Analyst by paying a prescribed fee. If the report proves the food is unsafe, the consumer gets their fee back.
Section 41: Power of search, seizure, investigation, etc.: Grants legal backing to the FSO to search premises, seize articles, and investigate potential offenses.
Section 42: Procedure for launching prosecution: Defines how an FSO should proceed after taking a sample, including the notification to the FBO and the timeline for analysis and launching legal action.

Section 45: Food Analysts: The Commissioner appoints qualified persons as "Food Analysts" who are authorized to analyze samples sent to the laboratory.
Section 46: Functions of Food Analyst: The Analyst must analyze the sample and send a report to the Designated Officer within 14 days. This report is admissible as evidence in legal proceedings.
Section 47: Sampling and analysis: Specifies the formal protocol for collecting, sealing, and sending samples to the laboratory to ensure transparency and prevent tampering. It ensures the FBO is provided with a portion of the sample for their own independent testing if they choose.
